BACKGROUND: Nailon Plumbing, the Owner of 101 Liberty Street is seeking to restore a portion of the building for use as a bakery. The building is located within the regulatory floodplain and the work is considered by FEMA to be a substantial improvement and is therefore required to be brought into compliance with the current regulations. However, due to the location and nature of the structure full compliance is not feasible. The building is also a on the National Register of Historic Places and therefore may be allowed to be subject to less stringent requirements. A variance is requested by the owner and supported by City staff in coordination with the IDNR.

Per Chapter 12 of the Municipal Code, this request was brought before the Construction Commission on September 11, 2019. The Commission voted to recommend the approval of 101 Liberty Street's variance request for the flood plain requirement per Chapter 12 of the City Code, with the condition that the basement space remain unoccupied and not used for new equipment, with the exception of the existing electrical and gas service.

NEIGHBORHOOD CONCERNS: None

IMPACT IF APPROVED: Approval of the variance will allow development within the downtown district and the continued revitalization of the riverfront. A restrictive covenant will be recorded with the Peoria County Recorder of Deeds stipulating the limitations set forth by the Construction Commission.

IMPACT IF DENIED: The proposed development will not be allowed or must be scaled back.
