Communication from the City Manager and the Corporation Counsel with a Request for ADOPT an ORDINANCE Amending CHAPTER 3 of the CODE of the City of Peoria to Allow a Supermarket Grocery Store with a SUBCLASS 12 SUPPLEMENTAL LICENSE to be Eligible to Hold a SUBCLASS 10 SUPPLEMENTAL LICENSE which allows for Off-Site Catering of Alcohol.

BACKGROUND: On November 11, 2014, the City Council approved Ordinance No. 17162 creating subclass (12) supplemental license that allowed a Supermarket grocery store with a minimum square footage of 24,000 square feet to have on-site consumption of alcohol at its restaurant that is located within the store. This allowed a Supermarket grocery to have a sit-down restaurant with full services of a typical restaurant including the sale and service of alcoholic beverages in conjunction with the sale and service of meals.

Currently, the City's Liquor Code allows only restaurants holding a valid Class "B" (restaurant) license to apply for and hold a subclass (10) supplemental in order to cater alcohol off-site. This allows the restaurant to sell and serve alcohol in conjunction with the service of food (meals) at approved locations other than the premises covered by the existing license.

The Ordinance before the City Council is an amendment to Chapter 3 that will add the ability for a Supermarket grocery store that holds a valid subclass (12) supplemental license to apply for a subclass (10) to cater alcohol at any approved off-site locations. The Supermarket grocery store will still be subject to the subclass (10)'s requirements and the annual fee of $800.

There were no objections or comments voiced by the City Council during the first reading of the proposed Ordinance at the City Council meeting on September 13, 2016.
