Request from the City Manager to ADOPT an ORDINANCE Proposing the Imposition of an Additional SALES TAX within the Existing WESTLAKE SPECIAL SERVICE AREA and Providing for a PUBLIC HEARING and Other Procedures in Connection Therewith. (4th Council District)

BACKGROUND: Westlake Shopping Center, LLC has made a request via its attorney, Bob Hall, to impose a 0.75% sales tax within its established Special Service Area (SSA). The Westlake SSA currently imposes an additional property tax levy in order to fund certain improvements to the parking lot and rights-of-way. According to the letter (attached), the proceeds from the additional retail sales tax will (1) fund the improvements to the north half of the Westlake Shopping Center parking lot in a manner similar to the south half; (2) repay the loan that was used to finance the improvements in the south half of the parking lot; and (3) reduce the property tax levy.

State law mandates that the City Council hold a public hearing before the imposition of any taxes within a Special Service Area. The attached ordinance sets that public hearing for the City Council meeting of June 24, 2014. In addition to the public hearing, Council will also consider levying this additional sales tax on the night of the 24th.

FINANCIAL IMPACT: This action merely sets a time for the public hearing.

NEIGHBORHOOD CONCERNS: Unknown, but this action sets a public hearing for June 24, 2014 at which members of the public may make their concerns known.

IMPACT IF APPROVED: The public hearing will be set for June 24, 2014.

IMPACT IF DENIED: The public hearing will be set for June 24, 2014.

ALTERNATIVES: The City Council could select a date beyond June 24, 2014. By law, there must be at least 60 days between adoption of the ordinance setting the public hearing and the actual public hearing.
