Communication from the City Manager and Corporation Counsel with a Request to APPROVE the SITE APPLICATION for a Class C (grocery) Liquor License with the Retail Sale of Alcohol at the SCHNUCK MARKETS, INC., 10405 N CENTERWAY DRIVE, Contingent Upon the Issuance of the Certificate of Occupancy, with a Recommendation from the Liquor Commission to Approve. (Council District 5)

BACKGROUND: Jed Penney, Associate General Counsel & Managing Officer, and Kevin Haney, Division Manager for Central IL, presented a Site Application for a Class C (grocery) Liquor License, with a Subclass 12 (grocery with restaurant) for 10405 N. Centerway Drive.
Pursuant to Section 3-53 of the City Code, the City Council approves only the site application for the Class C (packaged goods) since all subclasses except the site approval for Subclass 1 (4 a.m.) and 1a (2 a.m.) licenses, are approved by the local liquor control commissioner (Mayor or the Deputy Liquor Control Commissioner). Upon the City Council's approval of the Class C (packaged goods), the Subclass 12 (grocery w/ restaurant) can be administratively approved by the local liquor control commissioner.

NEIGHBORHOOD CONCERNS: There were no concerns expressed.
IMPACT IF APPROVED: Alcoholic beverages can be sold as packaged goods and upon approval of Class C site application, the Subclass 12 (grocery with restaurant) can be approved by the local liquor control commissioner.
IMPACT IF DENIED: This site will not be able to serve or sell any kind of alcohol.
