BACKGROUND: Holy Family Parish has requested the Vacation of a strip of right-of-way 15 feet wide by 900 feet long on the northern side of Reservoir Boulevard adjacent to parcel 14-30-254-012 in the Holy Family Park Subdivision. (See Exhibit 1 Plat of Vacation and Exhibit 2 for reference.)

In 2007, the Friary of Holy Family Parish was destroyed in a fire. During the Special Use review for the rebuild of the Friary, future plans for the Parish were discussed and it was noted that the planned expansion of the building would be at jeopardy, due to the close proximity of the right-of-way to the existing church building (approximately 10'). To accommodate the future expansion of the church and meet the setback requirements of the City, an additional 15 feet of land is needed. This 15 foot strip of land along the parcel will remove other partial encroachments into the right-of-way including part of the school sign, part of the dumpster enclosure, and part of the baseball field fencing that have been constructed in the past. Holy Family Parish requests the 15 feet of right-of-way vacation to accommodate their setback for future expansion of the church and removal of encroachments.

FINANCIAL IMPACT: None.

NEIGHBORHOOD CONCERNS: No known concerns. All adjacent parcels to the vacation request are owned by Holy Family Parish.

IMPACT IF APPROVED: Holy Family Parish will be able to plan for the future expansion of the church building and present encroachments of the right-of-way will be corrected.
