BACKGROUND: Development of the area south of the intersection of W Wilhelm Rd & N Hunters Trail Ct is proposed by the Developer. The developer, Dan Waibel, has an existing development agreement with the City through Growth Cell 1A agreements, Council Approval # 05-691 from Dec 20th, 2005. This included development work to commence on W Wilhelm Rd. Mr. Waibel paid escrow as his part of the Agreement.

At this time, development work necessitates the City to vacate a portion of Right of Way on what should be the private property-side of the east-west multi-use trail that is along the south side of W Wilhelm Rd.

City staff has no objections to this vacation.

Utilities have been solicited for their infrastructure locations, which shall be left in-place in privately agreed-upon easements between the site and such utility.

FINANCIAL IMPACT: None

NEIGHBORHOOD CONCERNS: The adjacent property will move forward with development proceedings, after recording the property Vacation.

IMPACT IF APPROVED: The developer will take the next steps toward Final Plat generation, knowing that the development's approach is to the appropriate owner.

IMPACT IF DENIED: The City will continue to own and maintain the pavement south of the multi-use trail.
