BACKGROUND: The Petitioner, Mark D. Walton, on behalf of Ron DiGiacomo of Trinity M.M.J., LLC is requesting to obtain a Special Use in Class C-1 (General Commercial) District for Adult Use Cannabis Dispensary. The dispensary will be located in building previously used as a retail establishment.

The Planning and Zoning Commission found the request met the Findings of Fact and voted 7 - 0 to approve the proposed use with the following waivers and conditions:

Waivers
1. Waivers requested for parking lot landscaping points, and parking lot perimeter requirements.
2. Waiver for existing conditions for setback along Northland, Glen and Renwood.

Conditions
1. Meet drainage Ordinance requirements.
2. Correct right-of-way encroachments.
3. Provide required accessible space signage.
4. Provide sidewalks on all three frontages, and corresponding right-of-way dedications as needed.
5. Provide a pedestrian and bicycle pathway to the main entrance.
6. Add three shade trees along Northland Ave.
7. Correct drive approach along Northland so that it no longer encroaches on the adjacent property.

FINANCIAL IMPACT: N/A

NEIGHBORHOOD CONCERNS: Two residents expressed concerns about proximity to schools, if in the case of retail theft would thieves run through the neighborhood, use of security guards and cameras, stated they believed this was not a family-friendly business, that recreational users are very different from medical users; and that the use is better suited to an industrial location.
