Communication from Council Member Ryan Spain with a Request to Provide DIRECTION to Staff Regarding Creating an Ordinance that Would Permit FOOD TRUCKS to Operate from City Right-of-Way.

BACKGROUND: In 2012, City staff worked to craft an ordinance that would allow food trucks to operate from the right-of-way. The effort was undertaken due to interest from potential entrepreneurs who wished to start food trucks. The ordinance was patterned on the existing food cart ordinances and provided for a number of regulations: parking in designated areas; fees; requirements for trash, clearances, etc.; and operating hours. The effort included two public meetings. The final proposed ordinance is attached. On May 12, 2012, the proposed ordinance failed on a 5-6 vote.

Since 2012, a number of individuals have discussed revisiting the issue. At the January 27, 2015 City Council meeting, I requested that Council indicate whether staff should pursue the issue again. I am seeking this direction so that staff can understand if there is general support for the concept in advance of expending effort to create an appropriate ordinance and to guide its construction. Food trucks are already permitted to operate from private property with proper zoning and owner's consent. The ordinance would be limited to the use of rights-of-way.

FINANCIAL IMPACT: None immediately. This request is only seeking direction on proceeding to craft an ordinance. Any food truck ordinance would include permit fees as well as add additional dining options to Peoria.

NEIGHBORHOOD CONCERNS: The effort to create an ordinance would include public outreach. Downtown restaurants, in particular, have expressed their opposition in the past.
