BACKGROUND:

In 2002, the City Council adopted an ordinance amending the Class K liquor license to facilitate the catering of alcohol at live theatrical performances. The ordinance created a limited exception for live theatrical performance facilities to have catered alcohol up to 15 days in any 12-month period (with no more than five continuous days). These restrictions mirrored those of the Class F temporary liquor license.

The City has received inquires from live theatrical performance facilities about expanding the number of performances at which they may have catered alcohol service. Theater seasons can exceed 15 days of performances and some even exceed even 30 days in total. Under the existing Class K liquor license, theater facilities are bound by the 15-day restriction and must selectively restrict catered alcohol service at some their performances. The inconsistent availability of catered alcohol at performances detrimentally impacts the overall success of local theaters.

The proposed ordinance would amend the Class K liquor license by removing the 15-day catered alcohol limitation on live theatrical performance facilities. The removal of this restriction would permit theater facilities to have catered alcohol service at all their performances. The option of catered alcohol service at all theatrical performances will increase ticket sales, attendance, and audience enjoyment.

NEIGHBORHOOD CONCERNS: None.

IMPACT IF APPROVED: The existing 15-day limitation on catered alcohol service at live theatrical performance facilities will be removed, thereby allowing catered alcohol service at all their live theatrical performances.

IMPACT IF DENIED: Live theatrical performance facilities will remain limited to 15 days of catered alcohol service in a 12-month period.
