Communication from the City Manager and Director of Community Development with a Request to APPROVE an ORDINANCE Amending Appendix A, the UNIFIED DEVELOPMENT CODE, of the City of Peoria Relating to the WAREHOUSE FORM DISTRICT. (Council District 1)

BACKGROUND: Petitioner Michael Freilinger, representing the Downtown Development Corporation, requested to amend certain sections of the Warehouse Form District relating to: 1) minimum height of the ground story finished floor; 2) building setback along the side lot line; and 3) parking setback exemptions.

At the Planning & Zoning Commission meeting Mr. Freilinger withdrew items 1) and 2) from consideration.

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 7 to 0 TO APPROVE the request to eliminate the ground story floor height elevation requirement. Note that the elimination of the requirement does not prohibit a development with an elevated ground floor.

FINANCIAL IMPACT: None

NEIGHBORHOOD CONCERNS (at the Planning & Zoning Commission meeting): None

IMPACT IF APPROVED: The Unified Development Code will be amended to eliminate the finished floor elevation of the ground story for buildings located in the Warehouse Form District. This will allow greater re-use opportunities of existing buildings which do not have an elevated first floor.

IMPACT IF DENIED: The Unified Development Code will remain as currently written which requires the ground story finished floor elevation to be at least 3 feet and not to exceed 7 feet in height.
