BACKGROUND: In 2017, the subject property was annexed to the City of Peoria along with a Special Use for Outdoor Recreation which included the following attractions: Miniature Golf, Batting Cages, Go-Kart and Dune Buggy Tracks, Bumper Boats, and a Playground.

The annexation agreement requires non-agricultural development of the property to connect to public sanitary sewer.

Petitioner Mark Larson is requesting to amend the annexation agreement to allow for a septic system until such time as a public sanitary sewer line has been extended to his property line. Allowing a septic system is a waiver of the public sanitary sewer connection required by Subdivision Section 2.13.11 Utilities of the Unified Development Code and Chapter 31-32 Private Means of Disposal of the City Code.

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 3 to 0, with 1 abstention, to APPROVE the request with the following conditions:
1) Septic system is allowed until a public sanitary sewer line becomes available to any adjacent parcel. At such time the septic system must be replaced with public sanitary sewer within 12 months.

Note that the recommendation from the Planning & Zoning Commission and Staff is to allow the septic system until a public sanitary sewer becomes available to any adjacent parcel. Mr. Larson is requesting the septic system until the public sanitary sewer line is extended to his property.
