Communication from the City Manager with a Request to ADOPT an ORDINANCE Amending Ordinance 17,211 Pertaining to Licensing of MOBILE FOOD VEHICLES. (District 1)

BACKGROUND: On April 14, 2015, the City Council approved an ordinance allowing food trucks to operate from the public right-of-way, but only in the Downtown Business District. Council also deferred for one month (until May 12, 2015) the issue of food trucks operating from the public right-of-way outside of the Downtown Business District. Within that discussion, Council directed staff to clarify and strengthen the language regarding the qualities of a record of sale that would need to be produced in order for the license to be renewed. Section 641(a)(9) now reads (emphasis added): "When seeking a renewal, licensees must submit an accurate record of sales, including date, time and amount of transaction from the previous year." This same language will be incorporated into the ordinance that allows food trucks to operate outside of downtown.
FINANCIAL IMPACT: The strengthened language regarding record of sales should help compliance and auditing of sales tax receipts.
