BACKGROUND: The residents at 301 and 229 N Kickapoo Terrace approached the city last year about dedicating the roadway that is part of their properties to the city. North Kickapoo Terrace is a dead-end road that is currently maintained by the City up to the point at which it fronts these two properties. A storm inlet is situated at the far end of the private section in an easement. There were some delays in this process due to some property boundary disputes. Although the process for accepting the roadway dedication had been laid out to the residents, during the time that the City was awaiting a signed deed from James and Angela Dillon, Melissa Phillips recorded a dedication deed with the County Recorder of Deeds as part of the process of selling the property at 301 N Kickapoo Terrace. A copy of the recorded deed is attached, along with that from James and Angela Dillon.

Attached is correspondence from City Engineer Gene Hewitt from 1994 that the City contemplated this dedication over 25 years ago.

FINANCIAL IMPACT: Acceptance will add approximately 100 feet of roadway to the city's maintenance responsibilities.

NEIGHBORHOOD CONCERNS: Given that this short section of roadway is a dead end with only one additional driveway on it there are no neighborhood concerns beyond the immediate property owners.

IMPACT IF APPROVED: Approximately 100' of roadway will be accepted into the city roadway network.

IMPACT IF DENIED: City legal staff will have to work with the existing property owner to deny acceptance of the dedicated right-of-way and the section of roadway would remain private.
