Communication from the City Manager and Director of Community Development with a Request to Concur with the Recommendation from the Planning & Zoning Commission and Staff to APPROVE a RESOLUTION Amending the First Amendment to Consolidated Initial and Amended/Restated ANNEXATION AGREEMENT for the Extension of the Acquisition Contingency for the Property having an Address of 9505 N IL ROUTE 91 (Parcel Identification No. 08-35-300-030), and N ORANGE PRAIRIE ROAD (Parcel Identification No. 08-35-300-030), Peoria, Illinois.

BACKGROUND:  Petitioner Christopher Oswald is requesting to extend the acquisition contingency date from June 30, 2019 to June 30, 2020 to provide additional time to work with IL Dept of Transportation for approval of right-of-way dedication.  Mr. Oswald reported that the issues are being addressed quickly.

 

No other changes to the annexation agreement are proposed.

 

The Planning & Zoning Commission voted 4 to 0, to APPROVE the request.

IMPACT IF APPROVED:  The acquisition deadline will be extended to June 30, 2020.

 

IMPACT IF DENIED:  The acquisition deadline will remain as currently stated of June 30, 2019, which may cause the annexation agreement to become null and void.
