Communication from the City Manager and Director of Public Works with a Request to Approve a PERMANENT EASEMENT for Minor Encroachments into the Public Right-of-Way for the Property Located at 1201 SW WASHINGTON STREET, Peoria, IL. [Council District 1].

BACKGROUND: For many decades, the subject property at 1201 Southwest Washington Street has had a small portion of the building encroaching into the Washington Street right-of-way, and a narrow access platform encroaching into the Spencer Street right-of-way. Modern land surveying technologies and current permitting processes make these types of encroachments very rare in new construction, but these minor encroachments are somewhat common in our older neighborhoods and business districts. The subject property may change hands, and the prospective buyers will want to know that these longstanding encroachments will not have an adverse impact or risk to the current and future owners. By granting a Permanent Easement for these existing encroachments, the City can formally acknowledge that these longstanding encroachments can remain. The permanent easement allows for only the existing features to encroach into the right of way. The features must be maintained in good repair by the owner. Staff recommends approval of this permanent easement, which affects PIN 19-09-358-002.
