BACKGROUND: On November 21, 2006, Ordinance No. 16,028 vacated portions of Goodwin Street and Shipman Street between R.B. Garrett Avenue and Fourth Avenue, and Fourth Avenue between Hightower Street and Richard Pryor Place, with reservations for any existing sewers and utilities to remain. In order to clean up a cloud on a property title, a developer is requesting the release of all easements within the bounds described with the exception of any existing utilities located in the vacated alley between Richard Pryor Place and Shipman Street and Shipman Street from the vacated alley to R.B. Garrett Avenue. This is a housekeeping measure as part of a real estate transaction. Therefore, the proposed Ordinance and Partial Release of Public Utility Easement are attached.

FINANCIAL IMPACT: No financial impact to the City.

NEIGHBORHOOD CONCERNS: N/A.

IMPACT IF APPROVED: A cloud on a title will be removed and a developer will move forward with a property transaction.

IMPACT IF DENIED: Cloud will remain on the title and the property transaction will not be concluded.
