BACKGROUND:
A bottle club, commonly known as BYOB, is an establishment that on a regular basis allows for the serving or consumption of alcoholic liquors brought into the establishment by the patrons for which any fee, subscription, membership, donation or consideration of any kind, direct or indirect, is charged or accepted, or which establishment provides for the sale of any retail items of any kind or nature whatsoever, including, but not limited to, the retail sale of food or general merchandise. Currently, only premises licensed for the retail sale of alcoholic liquor for onsite consumption can operate as a bottle club.

The proposed amendment to Chapter 3 of the City Code amends Class M liquor license to allow a 501(c)(3) that is located within the Riverfront Entertainment District to operate as a BYOB. Limiting the area in which a BYOB club can operate without going through and obtaining site approval will ensure ease in policing and enforcing any violations and will have less likelihood on negatively impacting residents, while supporting the live and vivacious environment of the Riverfront Entertainment District. In addition, the limited time period in which a Class M (BYOB Club) can operate adds another layer of protection to ensure that the BYOB will not have a deleterious effect on surrounding neighboring residents. Since there is no requirement that the location itself has to have site approval for the class of liquor license, the holder of Class M liquor license can utilize licensed caterers to serve alcohol in conjunction with the service of meals for events.
