BACKGROUND:
On September 9, 2014, the City Council passed an ordinance amending Section 3-101 of Chapter 3 of the City Code setting forth a temporary moratorium on the site approval for a Class "A" (tavern) or Class "G-A" (beer and wine only for a tavern) license for applicants whose primary purpose is to operate as a video gaming cafes and did not apply to businesses that would operate as a traditional restaurant or a tavern. The City Code defines a video gaming caf? as an establishment or a business whose primary purpose is to operate video gaming terminals as defined under the Illinois Video Gaming Act and in which the sale of pre-packaged foods or snacks and alcoholic beverages is only incidental to the operation of the video gaming terminals. Such a temporary moratorium carried an expiration date of March 1, 2015, unless extended by the City Council.

The proposed amendment to Chapter 3 of the City Code is the same temporary moratorium to be effective immediately upon passage with the expiration date of April 7, 2015, unless so extended by the Council.

FINANCIAL IMPACT: If the City Council adopts the temporary moratorium, the City will not realize license fees or its portion of the tax from the video gaming revenues from the video gaming cafes during the moratorium period.
