BACKGROUND:
Petitioner Tom Leiter has requested to amend the Private Street Agreement to allow for the installation of an access control gate at the intersection of Trailcreek Dr (private street) and Crestline Dr (public street). The gate would be activated by key cards held by the residents of Trailcreek Estates Condominium only. A knox box will also be mounted for emergency vehicles.

Trailcreek Estates Condominium is approved for 46 dwelling units located south of Pioneer Parkway, immediately east of the Rock Island Trail and accessible at the Knoxville Ave and Trailcreek Dr intersection. Initially approved in 2002, the development was amended in 2007 to add dwelling units with a condition which prohibited a secondary access connection to Crestline Dr until the City and the petitioner could reach an acceptable agreement addressing conditions such as safety, traffic volume, and design standards of Crestline Dr. At that time, City Staff noted that Crestline Dr was (and still is) ill-defined lacking curbs and gutters.

In November of 2013, the developer began work on the connection of Crestline Dr and Trailcreek Dr without plan review, approval, required permits, or city inspection. The City placed barricades to prevent further work. Recently, an inspection of the road work found that it met city standards and is acceptable.
