BACKGROUND:
Since 2012, the City has explored an ordinance that would allow food trucks to operate from the public right-of-way. On March 24, 2015 (first reading) and April 14, 2015 (second reading), the City Council considered Item 15-093 which outlined the criteria and process for creating a license for such food truck operations. The ordinance presented covered operation both within a defined "Downtown Business District" and outside of that district. The differences between the two areas pertained to total number of licenses issued, hours of operation and approved locations.

At the April 14, 2015 meeting, the City Council voted 10-1 to approve an ordinance that allowed food trucks to operate from public right-of-way in the Downtown Business District only. Council deferred a decision on how to regulate operation outside of this specified area until the May 12, 2015 meeting. Council sought additional information on potential locations and restricting the total number of licenses. Staff is requesting an additional two week deferral, until May 26, 2015, to compile the requested information and make revisions to the ordinance.

FINANCIAL IMPACT: The City would gain revenue from the issuance of the permits. To the extent that food carts increase the market for dining in Peoria, the City would receive additional sales and restaurant taxes.

NEIGHBORHOOD CONCERNS: Staff coordinated two public meetings (March 12 and March 16) on this topic and incorporated input into the ordinance.

IMPACT IF APPROVED: Item deferred.

IMPACT IF DENIED: Item not deferred. Council could vote on the original ordinance from April 14, 2015.
