BACKGROUND: On November 9 2012, bids for the Warehouse District Infrastructure Improvements were opened. On December 11 2012, the Illinois Department of Transportation awarded the contract for the low bid of $9,877,627.99 to R.A. Cullinan & Son, A Division of United Contractors Midwest, Inc. Work started on the Warehouse District projects in early March of 2013 and will be completed by November 30, 2015.

Because of the TIGER federal funding, the construction contract included a clause that required all steel on the project to be 100% manufactured in the United States. However, one of the pieces of steel needed to complete the planter railings was not manufactured in the United States. This component of the railing has a total value of $9,536.43. Attached are letters from major steel manufacturers and suppliers throughout the United States stating that this particular component is not available in the States.

The City has been working with the Illinois Department of Transportation on how best to address this issue. It was recommended that the entire planter rail pay item be removed from the TIGER contract and placed under contract between the general contractor (R.A. Cullinan) and the City of Peoria, directly. Entering into a contract with R.A. Cullinan for $322,386.75 will not impact the TIGER funding match and are funds that have already been accounted for in the project. This action will remove the pay item from the state contract and place it on a City contract.
