BACKGROUND:
Based on the conversation during the First Reading of this item and on other modifications to the larger Property Registration and Inspection Program that is being worked on concurrently, the administration is requesting that this specific item be withdrawn. A comprehensive revised program will be brought back to Council during the 2017 budget discussion.
The deadline to register property in the City of Peoria for the annual non-owner occupied property registration is March 1st. Property owners are mailed out renewal forms as well as reminded multiple times through print and electronic media of this deadline. However, some property owners refuse to voluntarily comply with this deadline. They often play a game of "wait and see", hoping that they will not get caught. Staff has issued 798 citations for failure to register this year with an estimated 1,500 to 2,000 citations still to be issued. If a property owner comes into compliance before a citation is issued, the City of Peoria has no mechanism to impose a late fee for the registration process. In addition, if the citation is dismissed by the Hearing Officer for whatever reason, property owners are not held to the same standard as those who are in compliance.
The attached ordinance would establish a $100 late fee for failure to register a property 30 days after the established deadline. This would incentivize compliance by the established deadline and not create a system that essentially punishes those who comply by the established deadline.
This ordinance change who only impact those property owners who refuse to comply with the already established ordinance.
