BACKGROUND: Petitioner: K. Santo Evans

At the City Council Meeting on August 9, the City Council directed Staff to bring forward an Ordinance, for a vote, that would approve the requested rezoning and special use. That Ordinance is included with this memorandum.

Request:
1) Rezone the property from a Class CG (General Commercial) to a Class I-2 (Railroad/Warehouse Industrial), and
2) Obtain a Special Use for Meat Processing and Packing, No Slaughtering, as described below, and in the attached documents.

The Planning and Zoning Commission voted 3 - 3, with one abstention, to approve the rezoning request; therefore the motion failed. The Commission's findings, based on the evidence presented, with respect to the factors in Section 2.8.6 of the Land Development Code, identified a potential negative impact. Because the requested special use requires rezoning, the Commission therefore did not vote to approve the special use request.

FINANCIAL IMPACT: N/A

NEIGHBORHOOD CONCERNS: 1. Two citizens opposed the request. One cited concerns including garbage, storage, and smell resulting from fish processing. The other citizen stated he did not believe the proposed facility was in the best interests of the community; and that he was interested in developing the property. 2.
