Communication from the City Manager and Corporation Counsel with a Request APPROVE an ORDINANCE Amending Chapter 18, Article 14 and Chapter 3, Article 20 of the CODE of the City of Peoria Pertaining to the SALE OF TOBACCO.

 

Body

BACKGROUND:

The City has regulated the sale of tobacco products since 1957. Recently, reports of the negative public and personal health effects of traditional forms of tobacco have increased consumer awareness. After a presentation by the American Heart Association (AHA) on March 5, 2018, the Liquor Commission recommended an increase in the age requirement for tobacco sales and purchase in the City from eighteen to twenty-one. Currently, the State of Illinois restricts the sale and purchase of tobacco products to minors under the age of eighteen.  Evanston, Chicago, Oak Park, Highland Park, Naperville, Deerfield, Maywood, Lincolnshire, Vernon Hills, Berwyn, Buffalo Grove, Lake County, Elk Grove, Mundelein and Riverwoods have all increased the age requirement to purchase and possess tobacco products to twenty-one. The AHA has also encouraged communities to eliminate penalties for possession of tobacco by minors.  AHA recommends placing liability on the sellers of tobacco rather than the youth that are often the victims of aggressive marketing campaigns. The State of Illinois has conferred upon the City Council the authority to determine by ordinance restrictions it believes proper upon the sale of tobacco within its corporate limits.

IMPACT IF APPROVED: Legal age to sell tobacco products within the City of Peoria will increase from eighteen to twenty-one. All penalties for possession of tobacco by minors shall be eliminated since youths are the victims of aggressive marketing companies.
