Communication from the City Manager and Director of Community Development with a Request to ADOPT an ORDINANCE Amending CHAPTER 5 Sections 5-296 and 5-264 of the City of Peoria CODE Pertaining to DESIGNATION AS UNFIT FOR HUMAN HABITATION and CRIMINAL HOUSING MANAGEMENT.

BACKGROUND:
On July 10, 2018, Council passed the following items:

A. APPROVE a CONTRACT with SALVATION ARMY PEORIA to Operate a Rehousing Program that Provides Rehousing Services to Tenants Living in Properties Designated as Unfit for Human Habitation by the Community Development Code Enforcement Division;

B. ALLOCATE the $50,000.00 payment from the 1505 on the Avenue Settlement to a Set-Aside Rehousing Program Project;

C. ASSIGN All Future Criminal Housing Management Fine Payments to a Set-Aside Rehousing Program Project for Sustained Program Funding;

In addition to the above items council received and filed a FIRST READING Review of an ORDINANCE Amending CHAPTER 5 Sections 5-296 and 5-264 of the City of Peoria CODE Pertaining to DESIGNATION AS UNFIT FOR HUMAN HABITATION and CRIMINAL HOUSING MANAGEMENT. This item requests adoption of these ordinance revisions. The revisions are summarized below:

Pertaining to Sec.5-296 (b)

- In instances that the condition of the dwelling was caused, in whole or in substantial part, by the neglect of the owner, that occupants may be reasonably rehoused at the expense of the City.
- That costs incurred by the City shall be reimbursed by the owner of the dwelling designated unfit for human habitation, provided that the condition of the dwelling was caused, in whole or in substantial part by the neglect of the owner.

Pertaining to Sec.5-296 (d)

- Covering up or removing a Code Enforcement placard from any dwelling shall be considered criminal housing management

Pertaining to Sec.5-296 (e)

- Renting or allowing a person to occupy any premises designated as unfit for human habitation shall be considered criminal housing man...
