ACTION REQUESTED:
Title
Communication from the City Manager and Director of Community Development with a Request to ADOPT an ORDINANCE Amending CHAPTER 13 of the CODE of the City of Peoria Pertaining to REFUSE CONTAINERS.

BACKGROUND:

After substantial discussion and revision, the recommendation before the Council this evening would institute the following:

1. Dumpsters located in Industrial Districts (I1, I2, I3) would not require screening.
2. Dumpsters in all other zoning districts that are visible from the public way or residentially zoned property would require screening.
3. Dumpsters are required - whenever possible - to be located on the side or rear of a property.
4. Dumpsters are required to be located at least fifty (50) feet from any residential property line, unless the dumpster is serving a residential use (apartments, etc.).
5. Dumpsters shall be screened on all four sides, with a minimum height of 6 feet, and a maximum height of 7 feet.
6. Screening (including gates) shall be 100 opaque.
7. Screening material shall be comprised of material(s) that match or complement the building materials of the principal structure.
8. Screening material consisting of wire, or chain-link material is prohibited.
9. Existing non-compliant screening will be allowed to remain until it is replaced, damaged beyond 50% of the replacement value, or the property is redeveloped.
10. All screening areas shall be required to be maintained per the Property Maintenance Code.

IMPACT IF DENIED: No change to current refuse container screening requirements.
