Communication from the City Manager and Director of Community Development with a Request to Concur with the Recommendation from the Planning & Zoning Commission to ADOPT an ORDINANCE Approving a SPECIAL USE in a Class C-2 (Large Scale Commercial) District, for an ASSISTED LIVING FACILITY for the Property Located at 7615 N HARKER DRIVE (Parcel Identification No. 14-07-227-005), Peoria IL. (Council District 5)

BACKGROUND: Petitioner, Erin Taylor Nevitt, is requesting to obtain a Special Use for an Assisted Living Facility located in an existing, approximately 10,000 sq. ft., single-story building. The facility would accommodate 16 residents and employ 10 -12 people.

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 4 to 3 to APPROVE with the following condition:
1) Update handicap parking fine to $350.

Staff's recommendation for approval included the following additional conditions:
2) Provide 64 points of trees for front yard landscaping.
3) Provide continuous landscape hedge, decorative masonry wall or combination thereof for parking lot perimeter landscaping along Harker Dr.
4) Install sidewalk along the frontage of Harker Dr.

FINANCIAL IMPACT: N/A

NEIGHBORHOOD CONCERNS (at the Planning & Zoning Commission Meeting): One neighbor expressed concern for their events negatively impacting the residents of the assisted living facility with excessive noise, traffic, and on-street parking. The neighbor was concerned about possible complaints from the residents. The neighbor also expressed concern for how the assisted living may impact their taxes, permits, licenses and city fees.

IMPACT IF APPROVED: The property may be used as an assisted living facility.

IMPACT IF DENIED: An assisted living facility will not be allowed.
