BACKGROUND: On December 15, 2020, the City Council approved a Consent Decree with the United States Environmental Protection Agency (USEPA) and the Illinois Environmental Protection Agency (IEPA) to remediate Combined Sewer Overflows (CSOs). (Ref. Council Action 20-303). This mandate requires capital investments of approximately $109 million over an eighteen (18) year time frame, beginning in 2022, to remediate combined sewer overflows

To begin program construction in 2022 to comply with the consent decree, design, monitoring and televising of sewers will need to begin now. As the Consent Decree was formalized in December 2020, these design funds were not included in the 2021 City budget.

With the approval of this budget amendment, we will have the ability to plan for projects to commence in 2022 per the consent decree.

FINANCIAL IMPACT: The Sewer Fund Balance will be reduced by $800,000.00 to perform green infrastructure design, system modification design, flow monitoring and data analysis, project management and sewer televising.

NEIGHBORHOOD CONCERNS: The CSO program is intended to improve our neighborhoods with the addition of green infrastructure.

IMPACT IF APPROVED: Funds will be available in 2021 to design the 2022 CSO program.

IMPACT IF DENIED: The mandated CSO program will be delayed and the City would be in violation of the consent decree.
