BACKGROUND: The subdivision plat for Willow Knolls Subdivision includes a six-foot-wide strip of right-of-way between Lots 10 and 11 dedicated to the City for a public sidewalk. When the sidewalk was constructed, it was partially built on Lot 10. In order to remove liability of this public sidewalk from the property owner and to locate the existing sidewalk entirely in the public way, the property owner is asking to dedicate the area containing the sidewalk as public right-of-way.

The attached plat of dedication shows the property to be dedicated along the west property line of Lot 10 (1734 W Willow Wood Drive).

FINANCIAL IMPACT: None.

NEIGHBORHOOD CONCERNS: None.

IMPACT IF APPROVED: The Dedication Deed will be recorded with the County, and the sidewalk will be located on public right-of-way as was originally intended on the subdivision plat.

IMPACT IF DENIED: The sidewalk would remain on private property, which is inconsistent with the intent of the original subdivision plat, and it could place unintended liability on the property owner.
