BACKGROUND: At the September 14th City Council meeting, Councilman Denis Cyr asked staff to bring back revisions to the City of Peoria code related to business licenses. On October 12th, multiple license requirements were removed from the City of Peoria Code. While staff mentioned eliminating the requirement of restaurants obtaining a license with the City of Peoria, the code change was not made due to a staff oversight caused by the requirements being in Chapter 27 of the City of Peoria Code.

This provision has not been enforced for multiple years due to a duplication of requirements with the Health Department. The license likely was originally created to ensure restaurants were paying their taxes to the City of Peoria. However, the Health Department now provides information on which restaurants have obtained a food license in the City of Peoria thus eliminating the need for the City to collect this information and charge a business a $25 fee. The code changes eliminate those requirements while at the same time increasing the penalty for failure to pay taxes to the City of Peoria.

FINANCIAL IMPACT: License requirements have not been enforced so there is no financial impact.

IMPACT IF DENIED: Restaurants would be required to obtain a business license with the City of Peoria. The City of Peoria will begin enforcing the requirement.
