Communication from the City Manager and Corporation Counsel with a Request to ADOPT an ORDINANCE Amending CHAPTER 3, SUBSECTION 59, of the CODE of the City of Peoria, to Revise SUBCLASS (1) SUPPLEMENTAL LICENSE AREA.

BACKGROUND:

The City of Peoria regulates local liquor licenses with a licensing scheme that involves the issuance of specific Classes and Subclasses, as outlined in the City's Municipal Code Sec. 3-52 and Sec. 3-53. A Subclass (1) license authorizes "the retail sale of alcoholic beverages until the hour of 4:00 a.m." See Sec. 3-53(a)(1). The City restricts the issuance of Subclass (1) licenses to the specific geographic area defined in Sec. 3-59. The existing Subclass (1) zone currently stretches as far east as Fayette Street, bounded by Perry Avenue, Kumpf Boulevard, and Jefferson Avenue to the north, and reaches westward to South Street. The Subclass (1) zone includes the Warehouse District. However, there is only one current Subclass (1) license holder in the Warehouse District - Status night club at 1412 SW Jefferson Ave, Peoria, IL 61605.

As the Warehouse District develops additional residential units, there are concerns that the area may no longer be suitable for additional Subclass (1) licenses. The boisterous nature of Subclass (1) establishments may adversely affect residents and obstruct the economic prosperity of the Warehouse District. Therefore, the proposed ordinance would revise the existing Subclass (1) supplemental license area to exclude the entirety of the Warehouse District. The one existing Subclass (1) license holder in the Warehouse District would continue to hold its Subclass (1) license so long as it does not lose site approval and abides by rules and regulations of its Subclass. Local liquor licenses could still be issued within the Warehouse District, but there would be no additional Subclass (1) licenses permitted in that area.
