Communication from the City Manager and Corporation Counsel with a Request to APPROVE a RESOLUTION Providing for the Surrender of the S-NET TRADEMARK.

BACKGROUND: 

The assignment of the S-Net Trademark to the City was signed by Rita Ali on March 10, 2022. The City legal staff has experienced difficulty perfecting the recordation of that assignment with the U.S. Patent and Trademark Office. The names of the parties required correction previously and the review of online information following a subsequent notice revealed and ownership interest held by Brandy Bryant. Mayor Ali indicated that she did not recall having included her daughter as a subsequent owner and the Mayor had not informed staff of this issue.

 

The City has determined that the use of the S-Net trademark is not likely in the future, and the surrender of the property interest by the City and Ms. Bryant, as well as Mayor Ali, if necessary, would provide a final outcome on this matter.

 

The Corporation Counsel would be directed to surrender the City’s interest in the Trademark and retain competent outside counsel to complete the transaction.

IMPACT IF APPROVED: The City of Peoria will conclude this matter

 

IMPACT IF DENIED: The City of Peoria would not have use of the Trademark, and the Trademark would expire in three years if the City did not provide the filings required to maintain the Trademark.
