BACKGROUND: Banner Elementary School, located at 12610 N Allen Road, of the Dunlap School District has a current septic system that is failing. The Peoria City/County Health Dept is requiring connection to the existing public sanitary sewer system located along Allen Road. According to Dunlap School representatives, repair or replacement of the existing septic system is not a viable option.

Since the Banner Elementary School is located within Peoria's 1.5-mile extraterritorial jurisdictional area and is seeking to connect to the public sanitary sewer, an annexation agreement with the City of Peoria is required.

The proposed terms of the agreement are:
1) Rezone (upon annexation) property to Class N-1 (Institutional) District.
2) Allow for immediate connection to public sanitary sewer.
3) Allow for existing school use to remain.

The property is currently not contiguous to the City of Peoria corporate boundary. Therefore annexation will not occur at this time but upon a future time if contiguity is established. Such contiguity must be established within the 20 year term of the annexation agreement. If contiguity is not established within 20 years, the property will not be annexed to the City of Peoria and the annexation agreement will expire.

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 6 to 0 to approve. See the attached Planning & Zoning Commission case packet and meeting minutes for additional detailed information.
