BACKGROUND: The proposed, attached Second Amendment to the Landfill Agreement accelerates the second installment payments due to the City and the County of Peoria under the Landfill Agreement. The accelerated payment is in exchange for Peoria City/County Landfill Inc.'s (PCCLI) right to operate the Peoria City/County Landfill No. 3 Facility at the same operating hours as the Peoria City/County Landfill No. 2 Facility. The Second Amendment to the Landfill Agreement also provides PCCLI the right to not open the Landscape/Waste Composting Facility when Landfill No. 3 begins operations in 2022 or 2023, which also mirrors the same right given to Waste Management in its Settlement Agreement with the Peoria City/County Landfill Committee. This second amendment to the Landfill Agreements reflects the proposal provided by PDC Services, Inc., an affiliate of PCCLI, in response to RFP #29-17 released by the City of Peoria last year for collection of residential waste, landscape waste and recyclable materials.

The Peoria City/County Landfill Committee approved the Second Amendment to the Landfill Agreement at its meeting on May 16, 2018 (minutes attached).

FINANCIAL IMPACT: If approved, Peoria City/County Landfill, Inc. (PCCLI) would pay $450,000 to the City of Peoria upon approval.

IMPACT IF APPROVED: The City of Peoria would receive $450,000.

IMPACT IF DENIED: The $450,000 would not be received by the City of Peoria until 2022 or 2023.
